Cocolalla, ID: (Jun-23-07) More than two dozen landowners filed suit against Ben and Julie Silverman and Redlands Financial Group, over the installation of a modular home at Cocolalla Estates. The suit contended the 2,000 square-foot home was contrary to Cocolalla Estates' covenants, conditions and restrictions, which forbid structures built off-site from being placed in the subdivision. Homeowners claimed that the home undermined the integrity of the CC&Rs and called for the home's removal. The Silvermans countered that they were told the homeowners association had disbanded and obtained verbal approval for the home from some of the landowners in the subdivision. They also unsuccessfully attempted to have the 1968 CC&Rs amended to account for new home building techniques.
In a settlement reached, Ben and Julie Silverman and Redlands Financial Group agreed to pay $15,000 to the property owners' association, which will invest the money into new docks on the lake and other capital improvements.
