Ivyland Cafe
Doylestown, PA: (Jun-29-07) Joseph Tuski of Pottstown brought a lawsuit against Michael Petaccio and the Ivyland Cafe, a tavern owned by Petacciao's parents. Tuski, a road worker, was left a quadriplegic when a car driven by Michael Petaccio struck him as he directed traffic on January 17th, 2001, in Warminster. Petaccio had just left the Ivyland Cafe, a tavern owned by his parents. The suit claimed that Petaccio was under the influence of alcohol when the accident took place. Petaccio pleaded no contest in 2001 to aggravated assault while driving under the influence.
In a settlement reached, the tavern's insurance company agreed to pay Tuski $20 million as compensation. A jury awarded Tuski $75 million dollars, but the award was largely symbolic since the tavern had only $1 million dollars in insurance. Tuski sued the bar's insurer for bad faith when it failed to negotiate a settlement after the verdict. [WHP TV NEWS: PARALYZED ROAD WORKER]
