The most recent case in the spate of lawsuits filed against the state is that of the Smiths. Frachon Smith, a mother of four, lived in a home situated at 1402 Dudley Ave. Smith filed a lawsuit against her landlords where the family lived. The lawsuits claimed that the landlords knew that the Dudley Avenue apartment was built when lead-based paint was common and that the landlords knew paint was peeling there and that children lived there. She claimed that her two sons, Kwamae Smith, now 17, and Dezmin Warmack, now 16, experienced learning disabilities and behavior problems and had several medical complaints, causing her emotional and financial anxiety.
In a settlement reached, the family received a total of $365,000 for Kwamae Smith. Once Smith is in his mid-20s, he will receive 40 years of guaranteed monthly payments in two structured settlements. The settlement also included a payment of $92,500 for Dezmin Warmack. Warmack will receive guaranteed lump sum payments at various intervals of his adult life as well.
