Sebastian River Medical Center
Miami, FL: (Jul-27-07) A whistleblower lawsuit filed by anesthesiologist Thomas Gayeski, alleging that Linda Bland, a board certified neurosurgeon performed more than 150 unnecessary surgeries at the Sebastian River Medical Center. The suit claimed that Bland's performance of unwarranted spinal surgeries evolved into a routine custom, pattern and practice and that Gayeski had repeatedly complained to the hospital, but administrators ignored his warnings.
In a settlement reached, the Sebastian River Medical Center and Bland agreed to pay the federal government $1.275 million for performing unnecessary spinal surgery on Medicare patients. Under the terms of the settlement, the hospital paid $925,000 and Bland paid $350,000. Gayeski will get $230,000 of that.
