Westra Construction
Juneau, WI: (Aug-08-07) A lawsuit was filed against Patrick Flynn, a Westra Construction executive, accusing him of withholding payments to a subcontractor. The charges against Flynn stem from a contract dispute that occurred more than two years ago among Westra Construction, Green Valley Enterprises Inc., and Badger Excavation, a Princeton-based subcontractor. The lawsuit alleged that Flynn, 59, of Harrisburg, PA, instructed employees to withhold $106,358 in payments to Badger Excavation for excavating work resulting in a construction lien against the new $1.43 million Green Valley adult daycare center and warehouse in Beaver Dam.
In a subsequent compromise, Green Valley paid Badger Excavation $58,000 in exchange for the construction lien being dropped. During the investigation, Flynn maintained that the $106,358 payment was withheld due to an unrelated side project in which he believed the Princeton firm owed money to Westra. Subsequently, Flynn told investigators that the debt was not paid because Westra simply ran out of money.
In a settlement reached, the Dodge County District Attorney said that he had received a $55,000 money order from Flynn. Sources state that the settlement is coming out of Flynn's own personal account. Of the settlement, $40,000 will go to Green Valley Enterprise Inc. while Badger Construction will receive $15,000.
