Bayonne, NJ: (Aug-13-07) Catherine Schmidt, a lifelong Bayonne resident, filed suit against the city, alleging that negligence on the part of the city resulted in her stepping off the curb near the intersection of Avenue C and West 13th Street, tripping and breaking her left ankle. Schmidt, who was 50 at the time of the mishap on Sept. 30, 2001, had surgery on her ankle at Christ Hospital, Jersey City, in January 2003. Sources state that doctors inserted plates and screws to straighten the fracture.
In a settlement reached, the Bayonne Insurance Commission agreed to pay Schmidt $75,000 for pain and suffering and for the permanent disability she suffered as a result of the accident. Earlier, an arbitrator had awarded Schmidt $150,000 but the city challenged it in the Appellate Court and came away with a compromise which Assistant City Attorney Christopher Patella recommended that the insurance commission accept.
