Saginaw, MI: (Aug-14-07) Gregory Willis, a Delphi Corp. retiree, volunteer tutor in Saginaw schools, and anti-violence activist, brought charges against the city, after he suffered a torn rotator cuff when officers roughed up his left arm during a case of mistaken identity in May 2004. In his suit, Willis claimed that the two officers removed him from his car at a Rally's Hamburgers drive-through at 515 S. Michigan. The officers denied the accusations, claiming they had probable cause to arrest Willis because his car matched the description of one that Rally's employees reported acting suspiciously.

In December 2006, US District Court Magistrate Charles E. Binder ruled in Willis' favor, denying the city's motions for summary judgment on his claims of assault and battery, false imprisonment and malicious prosecution. Binder's recommendation states that a Rally's manager told police Willis was not the man restaurant employees had called about. In a settlement reached, the city agreed to pay the 53-year-old Saginaw man $80,000, ending his three-year legal fight with city police. [SAGINAW NEWS: MISTAKEN IDENTITY]
