Lancaster County, PA: (Aug-24-07) Warfel Construction brought a breach of contract lawsuit against Harrisburg Area Community College developer Pitney Road Partners, over the final payments on the $22 million expansion. In a long awaited settlement, which was reached out of court, Pitney Road Partners and others paid Warfel nearly $5 million. Warfel then paid its subcontractors the balance owed on their contracts, but no interest or legal costs. At issue was the remainder owed by Pitney Road Partners on the 2004 project. With interest, penalties and costs since then, that sum had ballooned to more than $7 million from the originally contested amount, $4.2 million. Rodney Hess, a subcontractor and his 45 fellow subcontractors on the Harrisburg Area Community College expansion project could finally cash in on their payments. But after waiting three years to get paid the balance due him on the Lancaster Campus job, the Manheim excavator had to drive up to the North Prince Street office of project general contractor Warfel Construction, which had finally received its funds from the developer, and pick up the $30,000 payment in person.
