Windsor Locks, CT: (Aug-28-07) Lynn Mulkern of Windsor Locks, who was injured along with her son Ryan when their vehicle was struck by a police cruiser July 1, 2002, filed a lawsuit against the town. The lawsuit, dated June 25, 2004, holds the town accountable for a collision involving Mulkern and Windsor Locks Police Officer Joseph Oliveira Jr. Reports show that Oliveira was headed south on Center Street when he responded to a medical call, activating his lights and sirens. The traffic light was red as he approached the intersection between Center Street and Spring Street. Mulkern and her son were headed east on Spring Street and had the green light as they approached the intersection. According to the report, witnesses said Oliveira came to a complete stop before proceeding through the red light. Mulkern was reported to be traveling faster than the posted 35 mph speed limit. According to the report, Mulkern told witnesses her windows were up and her radio and air conditioning were on as she approached the intersection. She said in the report that she did not see or hear the police cruiser approaching.

The cars collided as they headed through the intersection, causing extensive damage to both the Ford police cruiser and Mulkern's 2000 Honda. Oliveira sustained injuries to his right leg, arm, shoulder, neck, and back and was transported by ambulance to St. Francis Hospital in Hartford. According to the report, Mulkern was injured in the left arm and leg, and her son, who was in the back seat, received a slight bruise to the left forehead. They were transported by ambulance to Bay State Hospital in Springfield, where they were released later in the day. The suit claimed that serious injuries during the collision, requiring substantial money to cover medical care and physical therapy. The lawsuit claimed the Mulkerns suffered more injuries than stated in the police report. The lawsuit accused Oliveira of negligence, claiming he drove too fast, failed to obey traffic signals, and failed to properly control the vehicle, among other infractions.
