Mt. State Bit Company and Lancer Insurance Company
Fairmont, WV: (Aug-29-07) Marion County and the county's Parks and Recreation brought a lawsuit against Mt. State Bit Company and Lancer Insurance Company, over damage to the East Marion Park wave pool. County officials say the damage occurred after the company used explosives to remove rock and dirt near the gateway connector project. Following that, the pool then had to be closed for a few months in the summer of 2005 while crews worked to fix cracks in the pipes underneath the concrete floor. The suit claimed that the explosives also damaged the Vietnam Veterans memorial wall.
In a settlement reached, Mt. State Bit Company and Lancer Insurance Company agreed to pay $25,000 to end litigation. Sources state that the money is not for the damages, it is for the lost revenue as a result of the pool being closed that summer. Reports show that Mt. State Bit Service denied the allegations about the damages but agreed to reimburse the county for its loses. [WBOY TV NEWS: WAVE POOL DAMAGE]
