Tracy, CA: (Sep-09-07) Tracy resident Carole Dominguez filed a complaint with the California Public Utilities Commission (CPUC), claiming Pacific Gas & Electric (PG&E) fraudulently obtained a waiver in December 2004 for a nearly one-mile natural gas pipeline located under city-owned property, the designated home for a future youth sports complex. A lawsuit was filed after Dominguez was later joined by Robert Sarvey and Californians for Renewable Energy in the complaint against PG&E over the Tracy pipeline. The suit was to focus on whether PG&E should be granted a waiver for safety requirements, whether safety and mitigation measures are enough to protect the public safety in view of the city's plans to develop the property, if PG&E violated terms of the waiver by failing to install protective fencing around the pipeline during removal of poles and guy wires from the property.
In a settlement reached, Pacific Gas & Electric Co. filed a joint settlement motion with the California Public Utilities Commission, committing $2.5 million to replace approximately 5,000 feet of natural gas pipeline if the Tracy Youth Sports Complex is built.
