Sparks City, NV: (Sep-10-07) Stacy Gorbet, a city resident, brought a lawsuit against Victor Martinez, a Sparks Police officer, the Sparks Police Department, and the city itself, after an incident in 2003 left her seriously injured. On Nov. 28, 2003, suspect Victor Martinez was fleeing from Sparks Police in a stolen car. During the high-speed police chase, Martinez's car crashed into a car driven by Gorbet, 23, of Sparks. Gorbet broke two vertebrae in the crash, and is anticipating future surgeries to repair her injuries.
In a settlement reached, the city agreed to pay $40,000 to Gorbet, resolving the lawsuit. According to the settlement, the city will deny any wrongdoing or liability, and will deny any negligence by the Sparks police officer involved. The city was advised to settle the case because of the uncertainty of a jury trial, vague police chase laws, and that potential attorney's fees and costs could be double the amount of the current settlement.
