San Bernardino, CA: (Sep-16-07) Colonies Partners filed a lawsuit against the San Bernardino County Flood Control district, regarding a flood control basin at one of Colonies Partners's large development sites in Upland. The county settled in November 2006 with a $102 million payout. The San Bernardino County Flood Control district then sued Travelers Insurance, over a $10 million policy the district had with the firm to cover events such as those involved in the Colonies case.
In a settlement reached, the insurance carrier agreed to a $9.5 million payout, resolving the claims. The district stated that it will now focus on securing payments from various insurance companies affiliated with American International Group Inc. that have similar multi million dollar policies covering the district. The county will also pursue legal action against Caltrans, San Bernardino Associated Governments and the city of Upland, which bear portions of the responsibility for the circumstances that led to the Colonies settlement.
