Utica, NY: (Sep-14-07) Mark Rashford and 11-year-old Sabra Jones of Whitesboro brought a lawsuit against the city in 2002, following an accident that occurred when the tube they were sledding on at the ski area struck an exposed concrete corner of a ski lift tower at the Val Bialas ski hill in December 2000. The lawsuit alleged that the city did not provide adequate safeguards for tubing, which should not have been allowed at the ski area. Rashford's case went to trial in state Supreme Court early September 2007, but it ended after four days, according to court officials. Jones is no longer part of Rashford's case after she reached a $15,000 settlement with the city. Rashford's civil action is nearing settlement with sources claiming that the payout can be as high as $750,000. Attorney's in the case say that a significant settlement has been reached, though both sides are not disclosing the facts as yet.
