Underage DUI
This is a settlement for the DUI/DWI lawsuit.
Waukegan, IL: (Sep-20-07) Melissa Wolkomir brought a lawsuit against Kelly's on 41 Equestrian Center and Patch 22 Ltd., after she was seriously injured in a car accident following a party where alcohol was served to minors. The suit stated that Wolkomir, then 16, had attended a Halloween party at "Kelly's on 41 Equestrian Center" and "Patch 22 Ltd." in Wadsworth on Oct. 30, 2004, with three girlfriends, all minors from Kenosha. The barn party had been hosted by the center and the hay ride company. Wolkomir claimed that free kegs of beer were available to all guests and minors were not required to provide identification. Wolkomir, who was in the back seat, was thrown out of the car and suffered serious neurological injuries, when the car was hit by a tractor-trailer truck. The injury is permanent and restricts the use of her left hand and leg. Sources state that she requires annual treatment. In a settlement reached, the court imposed civil liability against persons over 18 who allow minors to drink, and awarded Melissa Wolkomir $1.5 million, ending the lawsuit.
