Bridge Eminent Domain
Red Bluff, CA: (Oct-05-07) Shasta County Sheriff Tom Bosenko and his three sisters filed suit against Tehama County over a bridge project that crosses their property south of town. The suit, filed by the siblings aimed at challenging an eminent domain proceeding that split their property to accommodate the straightening of Rawson Road and replacement of a bridge over Red Bank Creek. Sources stated that as per records, a temporary bridge was put in place after a 106-year-old crossing was destroyed in late 2000 when a car sped through a curve on Rawson Road and hit a steel truss. The collision knocked the truss off a pillar and caused the bridge to collapse into the creek bed.
Records show that Tehama County offered Bosenko's family $71,000 for about 5½ acres of easement needed for a new road alignment and bridge, but the family wanted $152,000. County officials claimed that the route that bisects the land owned by Bosenko and sisters Marlene Green, Carole Smith and Janis Bosenko was one of three alternatives considered by the county. The two other routes would have presented other problems, such as conflicts with wetlands and vernal pools, twisting bridge approaches or, in one case, the need to move a Pacific Gas and Electric Co. natural gas pumping station.
