Wastewater Overflow
Holyoke, MA: (Oct-18-07) Travelers Insurance brought a lawsuit against the city on behalf of property owners whose property was damaged by overflow from a wastewater treatment plant run by the city in April 2003. The insurance company claimed that the city was negligent when it flooded several businesses. As part of a settlement reached, the city council unanimously approved of paying $500,000 to resolve allegations. Mayor Michael Sullivan stated that he also requested $75,000 in free cash to pay for the city's legal fees associated with the issue. The council referred the $75,000 request to the council's Finance Committee. The city did not admit wrongdoing; officials claimed that the settlement was reached in order to avoid the risks and costs associated with litigation.
