School Athletic Fields
Nashua, NH: (Oct-17-07) The city of Nashua brought a lawsuit against several parties over the quality of the athletic fields at Nashua High School North. Shawn Smith, director of plant operations, said the upper fields, those closest to Broad Street, have been unusable after rain because the water does not drain off the fields. The suit named Gilbane Building Co., the firm hired by the city to oversee the $143 million high school project. In 2005, Gilbane had filed a lawsuit against Amsco Inc., a business based in Londonderry that was subcontracted to build the athletic fields at the two high schools and Stellos Stadium. The city stated that the fields built were of substandard quality due to the negligence of the contractors.
As part of the deal, sources state that the city stands to receive a total payout of $750,000 from several parties. The settlement would include a $450,000 payment from Amsco. Some of that money, an estimated $212,500 will come from payments the city has not yet made for the work. Amsco is said to pay the additional $237,500. Under the deal, Gilbane would contribute $125,000 as part of the settlement, $82,000 of which comes from the company's legal fees associated with the lawsuit. [NASHUA TELEGRAPH: SCHOOL FIELDS]
