Copied Art

Honolulu, HI: (Nov-01-07) Photographer Kim Taylor Reece brought charges against Marylee Leialoha Colucci and Island Treasures Art Gallery in Kailua, alleging that the stained glass artist copied his photo of a hula dancer. The two works are strikingly similar. They depict a dancer in kahiko, or ancient hula, attire sitting on the sand performing an "ike" move with one arm outstretched. The suit claimed that Colucci's stained glass piece cannot be commercially displayed, sold or offered for sale, and that to do so would be theft of Reece's intellectual property. Though neither Colucci nor gallery owner Gail Allen accepted any liability, they did agree to pay $60,000 for attorney fees. The settlement was reached as a bid to avoid the risks and costs of protracted litigation. [KHNL NEWS: COPIED ART]
