Mercantile Taxes
Wilkins, PA: (Nov-01-07) ProCare Pharmacy Direct Inc. brought charges against Wilkins Township, alleging that it was overcharged more than $2 million in mercantile taxes paid between 2004 and 2006. The suit sought a refund of the excess amount paid. The company, a subsidiary of CVS/Caremark Corp., originally sought the funds through an appeal filed on April 12, 2007. Records state that ProCare's facility at 600 Penn Center Blvd., is the township's biggest taxpayer.
As part of a settlement agreement reached, Township Manager Rebecca Bradley, Solicitor Jack Cambest, and Auditor Bob Tomasic reached an agreement with ProCare CEO Robert McTiernan, where the township agreed to repay $950,000. In exchange, ProCare agreed to drop its appeal from 2005 and 2004 tariffs. As per the deal, ProCare will continue to pay taxes according to township and federal codes and three new divisions of ProCare will be added to the township's tax rolls. ProCare had sought $2,025,528, but agreed to the $950,000 payout, which the township will make through an escrowed $1.2 million from ProCare's 2006 tax payments.
