Jail Negligence
Macon, GA: (Nov-13-07) Valencia Gary, daughter of Jerry Butts, a man who died in the Bibb County jail, brought a lawsuit against the county, alleging that the death occurred as a result of negligence. Records show that Butts, 55, was arrested at his home Oct. 16, 2001, and charged with violating his probation, because he possessed a firearm with an altered serial number. He was taken to the Bibb County Law Enforcement Center, where he was incarcerated. He died a day later. The suit claimed that the sheriff's deputies failed to provide Butts with medication or attention, even after he complained of severely swollen ankles and feet. Butts collapsed on the jail floor, where he was largely unresponsive and had to be helped back to his cell by other inmates, according to legal documents. A coroner's report stated that Butts died of acute heart failure. As part of a settlement reached, Gary agreed to accept $350,000 from the county as compensation for the death of her father.
