Boston, MA: (Nov-19-07) Alfie Kohn, a MCAS critic, brought charges against the state Department of Education, alleging that his rights to free speech were violated when he was prevented from speaking at a 2001 state-run conference. Kohn claimed he was scheduled to deliver a keynote address, when the organizers violated his rights and deprived others from hearing his views.
As part of a settlement reached, the Massachusetts Department of Education board admitted that it had violated Kohn's free speech rights, and agreed to pay him $187,000, resolving the allegations. In the settlement, Kohn will receive $7,500 and his attorneys will get $179,500, according to the state chapter of the American Civil Liberties Union, which filed the suit on behalf of Kohn, as well a school principal, a counselor and a parent.
