Police Van
Rochester, NY: (Jan-02-08) Cherese Dukes, the widow of Shawn Dukes, brought a wrongful death lawsuit against the city, following her husband's death while in custody of Rochester Police. Sources stated that Dukes died after he called 911 for help. He had a heart attack while handcuffed and lying down in the back of a police van. His widow sued, naming the city, the county, the police chief at the time, Mayor Bob Duffy, and the seven police officers who responded. Sources claimed that an autopsy report showed there was cocaine in Shawn Dukes' system and that he had a slightly enlarged heart. The mayor's office says the arrest was justified, but police should not have left Shawn Dukes unattended like they did.
Spokesman Gary Walker said the settlement was fair and reasonable. As part of a settlement reached, the city agreed to pay $500,000 to Cherese Dukes and her children. After fees, the Dukes' family will get a little more than $300,000. The settlement specifically allocates $72,834 to each of Shawn Dukes' three children.
