Ontario, Canada: (Jan-07-08) Carolyn Bovingdon, the mother of severely disabled twins, brought a medical negligence lawsuit against Sault Ste. Marie, Ontario obstetrician Paul Hergott, alleging that he failed to warn of risks associated with Sanofi-Aventis's Clomid fertility drug. Sources stated that Clomid increases the chances of having twins and raises the potential for premature births and related injuries, according to trial testimony. Bovingdon testified that Hergott claimed that she would never face any such eventuality. Bovingdon became pregnant with twins in May 1992 and they were born prematurely with severe disabilities that will require supervised care for the rest of their lives. The judge ruled that Hergott was negligent in minimizing the risk of Clomid and was responsible for the cost of the children's care past the age of 19. Hergott was also responsible for the children's disabilities.
Sources stated that a jury in 2006 ordered Hergott to pay $12.5 million, which today would be about $14 million with interest. Hergott appealed the verdict. Both sides agreed on an $8.6 million settlement, resolving the suit. [BLOOMBERG: DISABLED TWINS]
