Employee Disability Discrimination

Worthington, MN: (Jan-13-08) The US Equal Employment Opportunities Commission (EEOC) brought charges against Schwalbach Holdings, Inc., alleging that the company fired a man when he revealed he had multiple sclerosis. The suit, filed in September 2006, accused Schwalbach Holdings, which owns and operates Schwalbach Ace Hardware in Worthington, of violating the Americans with Disabilities Act. Sources close to the case stated that the company had agreed to resolve the lawsuit and had entered into a settlement, paying out $40,500 and agreeing to engage in other affirmative action relief as part of a three-year injunction entered by the court. The injunction stated that Schwalbach is prohibited from engaging in disability discrimination and retaliations against persons who oppose unlawful conduct.
