Cross Dispute
San Diego, CA: (Jan-15-08) James McElroy, a city attorney, brought a lawsuit against the city of San Diego, alleging that he was owed legal fees resulting from the Mount Soledad cross dispute. Sources stated that as per records, in May 2007, US Judge Gordon Thompson Jr. ordered the city to pay McElroy more than $900,000 in legal fees for his work on the Mount Soledad cross case brought by atheist Philip Paulson, who challenged the presence of the religious symbol on city land. The suit, filed in 1998, contended that having a Christian symbol on public land was unconstitutional. Paulson died of liver cancer in 2006. President Bush signed a bill in August 2006 transferring the land on which the cross sits to the federal government, thereby removing the city from liability. McElroy filed a suit challenging that move. In a recent development, the City Council agreed to pay McElroy $750,000, resolving the lawsuit.
