Lead Paint Poisoning
Baltimore, MD: (Jan-23-08) Chantey Holmes, the mother of 8-year-old Antonio Ross Jr., brought a lawsuit against Garden Village Realty Corp. and property manager Regional Management Inc., claiming they ignored her complaints about the condition of the paint in her apartment and leaks in the roof and ceiling. The suit also saw the 8-year-old boy allege that paint conditions in his mother's apartment caused his lead poisoning and consequent loss of cognitive and motor skills from which he still suffers today. Regional Management claimed Antonio's exposure to lead occurred elsewhere, pointing to the house where Antonio's father lived on Cliftview Avenue in Baltimore. The dispute stemmed from an October 2001 diagnosis, which showed high lead levels in Antonio's blood.
Records state that the Baltimore City Health Department visited Garden Village and issued a violation notice. As part of a settlement reached, a Baltimore jury has awarded $6 million to Antonio Jr., though the verdict will likely be capped between $590,000 and $620,000 under Maryland's law limiting non-economic damages.
