Heavy Metal Contamination
Ottawa County, OK: (Jan-28-08) Over 200 families filed a civil suit against Asarco Mining Company, alleging that contamination caused by high levels of arsenic, cadmium, lead and other heavy metals, resulted in health problems in children. The suit stated blood tests showed that residents in the Tar Creek Superfund Site in Ottawa County had high levels of the toxic chemicals.
The now bankrupt company has agreed to a $20.7 million settlement, which will be paid out to several residents in the Tar Creek Superfund Site. Company officials said that the money is not for property buyouts, though several residents are still involved in a property damage lawsuit, claiming the piles of chat in the area, and heavy strip mining below the surface, rendered their properties worthless. Asarco filed bankruptcy in 2005, but with profits from several copper mines the company still has in operation, it decided to settle and avoid the costs of further litigation.
