Rally Rights
This is a settlement for the Civil / Human Rights lawsuit.
Gettysburg, PA: (Jan-30-08) Bruce Davis, of York, brought a lawsuit against Gettysburg Borough and its former police Chief Rolf Garcia, alleging that his civil rights were violated during a January 2006 pro-abortion rights rally. The suit claimed that Davis was arrested after Gettysburg Police broke up a group of 25 pro-abortion rights ralliers because they did not have the required assembly permit. Davis said at the time he was cited for disturbing the peace and violating borough code.
Sources close to the case stated that a settlement had been reached and that the dispute would be resolved following a $22,500 payout by Gettysburg Borough. Additionally, under the settlement agreement, the borough was ordered to revise the "use of streets by processions and assemblages" section of its borough laws. Chief Judge Yvette Kane of Pennsylvania's Middle District issued an order Jan. 24 closing the lawsuit. Sources on both sides said that the settlement was reached to avoid the costs and risks of further litigation. [EVENING SUN: RALLY RIGHTS]
