Omaha, NE: (Feb-5-08) Kevin Pulver of Kenesaw brought a lawsuit against the city and police department, alleging that they kept him from publicly preaching on a city right of way near a local college. Pulver stated that the police chased him from the spot near Hastings College three different times in 2005 with threats of citation and arrest. His suit claimed that his constitutional rights had been violated, and that through it, he sought to have a Hastings' city ordinance defining "disturbing the peace" declared unconstitutional, as well as an undetermined amount in damages. Sources close to the case said that the parties had reached a settlement, resolving the dispute. Under the terms of the agreement, the city has to repeal it disturbing the peace ordinance within 30 days and to pay $1 to Pulver in damages. The city must also pay $10,000 in attorneys' fees and expenses.
