Landfill Washout
Middleboro, MA: (Feb-5-08) The town of Middleboro brought a lawsuit against Weston & Sampson Engineers Inc., over a long-running dispute at the landfill. The suit was filed in 2005, after torrential rains caused a washout at the landfill that damaged the liner of a new section of the site. Records show that following that, the town stopped payment to both companies and the Department of Environmental Protection stepped in and closed the landfill. Weston & Sampson had a $300,000 contract with the town to engineer and oversee construction of the expansion, and the Welch Corp., based in Brighton, had a $2.7 million contract to build it. Waste Management Inc. eventually took over construction, and the DEP later issued a five-year authorization to reopen the site.
As part of a settlement reached, Weston & Sampson Engineers Inc. agreed to pay the town $1.2 million and the Welch Corp. agreed to pay $1.5 million to resolve allegations. Town officials claimed it has been paying more than $10,000 a month to get rid of the solid waste from the wastewater treatment plant. That payment will end because the sludge will be dumped in the landfill at no cost. Waste Management will also begin paying monthly royalties that will total about $180,000 annually.
