Sangamon County, IL: (Feb-11-08) Eric Hersey, a National Guardsman, brought a lawsuit against Sangamon County and deputy John Gillette, alleging that he was wrongly arrested in 2004 and held in jail overnight. The suit claimed that Hersey came to Springfield on Aug. 13, 2004, to retrieve his medical records from Camp Lincoln to take with him to Washington State for a National Guard unit there. The suit stated that he said Gillette and Camp Lincoln personnel met him and told him there was an outstanding warrant for his arrest for being absent without leave from his Illinois Guard unit. Gillette, though, checked the national law enforcement database and found there was no valid warrant for his arrest.
Sources close to the case said that the two parties had reached a settlement, resolving the dispute. Under the terms of the deal, Sangamon County has agreed to pay Hersey $20,000 to end his federal lawsuit. The suit against the Sangamon County Sheriff's Office and deputy John Gillette was set to go to trial in US District Court, but the settlement was reached out-of-court, ending all pending litigation. County officials said that the $20,000 for the settlement will come out of county funds and is not covered by insurance. [SJ-R NEWS: WRONGFUL ARREST]
