Domestic Police Brutality
Baton Rouge, LA: (Feb-11-08) Levy Claiborne brought a lawsuit against East Baton Rouge, alleging that two Baton Rouge police officers sprayed tear gas on him and beat him with their nightsticks while arresting him on Feb. 4, 2006, for criminal mischief and resisting an officer. The police brutality lawsuit claims officers Stewart Tate and Carl Mayo kicked Claiborne in the face with their steel-toe boots while pressing his face into a concrete surface. The suit, filed in early 2006, sought $500,000 in damages. Claiborne also named the city, Mayor-President Kip Holden and Police Chief Jeff LeDuff as defendants. Police sources stated that Claiborne was arrested during a domestic dispute earlier that evening and warned by Baton Rouge police not to return to the residence. Claiborne disregarded police warnings and returned to the residence, when the incident took place.
As part of a settlement reached, the Metro Council has reached a tentative deal to end the controversial federal lawsuit. Parish attorneys have negotiated a $30,815 deal that would include $15,000 for Claiborne's medical bills.
