Excessive Arrest
Worcester, MA: (Feb-18-08) Daniel Houde brought a federal civil rights lawsuit against the city of Worcester and seven of its police officers, alleging that police used excessive force when they broke nine bones in his face while arresting him six years ago. Records show that Houde, 43, filed the suit in US District Court over his arrest on May 20, 2002. The suit stated that after officials of the downtown Palladium theater withdrew an offer to Houde to operate its pizza shop inside the concert venue, Houde continued to offer fast food outside the theater and elsewhere from a mobile food kitchen he operated called Mr. Fun Times, which did more business than the Palladium's pizza shop. Jack Fisher and John Souza, then owners of the Palladium, employed Worcester police officers at the Palladium and two other night clubs.
Sources close to the case stated that the lawsuit had reached settlement, with the city of Worcester agreeing to pay Houde $100,000 to settle the federal civil rights lawsuit. The city admitted no liability under the terms of the settlement and no costs were assessed in the dismissal of the suit. [WORCESTER TELEGRAM & GAZETTE: EXCESSIVE ARREST]
