Probation User Fees
Clark County, IN: (Feb-16-08) Clark County judges brought a lawsuit against the Clark County Council, after it appropriated probation user fees (PUF) in the 2005 budget to fund supplemental probation services, such as court reporter and bailiff salaries. The lawsuit stated that the judges objected to the use of PUF funds to pay for services that are supposed to come from the County General Fund. In addition to using the money to pay employee salaries, money was appropriated for supplies, law books and 90 percent of probation officers salaries, which had previously been paid entirely from the general fund. The judges claimed that PUF funds are meant to be used as a supplement in probation officers' salaries and probation services, not to cover the whole cost.
Sources close to the case stated that the parties had reached a settlement in which the council agreed to refund $1.1 million, ending all pending litigation. Following an Indiana Supreme Court ruling in favor of judges, the council will refund the PUF funds appropriated by it into the County Adult Probation Services Fund within 15 days.
