This is a settlement for the Trademark, Copyright, Patent lawsuit.
Detroit, MI: (Feb-19-08) Insituform Technologies Inc. brought a patent infringement lawsuit against Cat Contracting Inc., Michigan Sewer Construction Co. Inc., and Inliner USA Inc., alleging that the companies infringed on certain in-liner company patents. Chesterfield, MO, based Insituform Technologies provides rehabilitation and repair services to sewer, water and other underground piping without digging and disruption. The suit, initially filed in 1990, resulted in the court finding that one of Insituform's patents was willfully infringed and awarding the company $9.5 million in damages.
Sources stated that after subsequent appeals, the finding of infringement was affirmed, but the award of damages and finding of willfulness were subject to rehearing. Records show that a trial on these issues was held in 2006 and in September 2007, the court found that the defendants did not willfully infringe. In its ruling, the court also asked Insituform to submit a calculation of damages, including prejudgment interest. In December 2007, Insituform submitted to the court a damages calculation of $9.6 million, inclusive of prejudgment interest. In a recent development in the case, the US District Court in Houston approved a $4.5 million settlement to be awarded to Insituform Technologies Inc., resolving the patent infringement suit.
