School Bus Accident
Murray County, GA: (Feb-26-08) The families of children injured or killed when a train collided with a school bus in 2000, brought a spate of lawsuits against Murray County, GA, Schools. Records show that the collision killed Kayla Silvers, 6, as well as Daniel Pack and Amber Pritchett, both 9. Four other children were injured and that bus driver Rhonda Cloer served 90 days in the Polk County, TN jail after pleading guilty to three counts of criminally negligent homicide and four counts of reckless aggravated assault.
A settlement has been reached in the federal lawsuits, in which Murray County agreed to pay $300,000 to resolve claims. The legal counsel for the families stated that no amount of money will rectify the wrong done to the families. The settlement splits the $300,000 among the families of Amber, injured student Kevin Sherrill and train crewman Kendrick Perry, court records show. About $44,000 of accumulated interest will be split equally among the families of students Brittany Gaddis and Jordan Manis and train crewman Roger Farley. It was conjectured that sovereign immunity, which protects government from being sued without its consent, shielded the school system from a larger payout.
