Contractor Dispute
Darien, CT: (Mar-02-08) Pipe & Power, the contractor for the Darien High School Building Committee, brought a $2.4 million claim against the town, alleging that in order to finish the job on schedule, it had to add men. The project also took four months longer than planned, which contributed to the claim. Records show that Pipe & Power was the Darien High School Building Committee's biggest contractor, brought on for $12 million to do the plumbing and heating, ventilation and air conditioning.
Town sources said that when Pipe & Power was hired, it sub-contracted Elmsford Sheet Metal to lay the sheet metal duct work, a $3.4 million job. The town and the sheet metal company had no contract. In the middle of the project, Pipe & Power went bankrupt. The bonding company NGM then stepped in and spent an extra $400,000 to finish the job. The claim was filed by Pipe & Power, Elmsford Sheet Metal and NGM. Sources on both sides stated that the parties had reached a settlement agreement, in which, fearing a battle in federal court, the Town's Board of Selectmen unanimously approved a $550,000 payout with the contractor, ending all claims in the three-year-old disagreement.
