River Damaged
Mountain Home, AR: (Mar-08-08) The Arkansas Department of Environmental Quality brought a civil lawsuit against Homeport Land Co. of Yellville, a land developer, alleging that it foiled a stretch of the North Fork River. The state sued Homeport in August 2006, alleging the company failed to obtain the required construction storm-water permit before clearing land at Overlook Estates adjacent to the North Fork River. The suit stated that Homeport also didn't establish erosion controls to prevent sediment from leaving the 100-acre site and running into the river.
Sources stated that the parties had reached a settlement in the case, in which state environmental regulators proposed $422, 800 in civil penalties against Homeport and its owner, Benny Doyal of Yellville, for violating environmental regulations at Overlook Estates residential subdivision below Norfork Dam in Baxter County and three other developments. Officials claimed that the settlement averted a trial in Baxter County Circuit Court, though all the details of the deal were not being revealed presently.
