Immigrant Discrimination
This is a settlement for the Discrimination lawsuit.
Saugus, MA: (Mar-11-08) Immigrant workers brought a class action lawsuit against Jin Asian Cuisine Restaurant alleging wage irregularities. The lawsuit, which was initiated by four Latino workers and two Chinese wait-staff, claimed that the restaurant did not pay the Latino workers minimum wage or overtime and administrative fees were taken from the Chinese waiters' tips. The workers reported a pattern of illegal tip theft to cover the base pay of other employees, improper wage deductions for meal breaks, discriminatory practices and non-Chinese temporary workers being paid a much higher rate than Chinese employees. They also complained of retaliation for speaking up about these problems.
In a settlement reached, Jin Asian Cuisine Restaurant, a 1,000-seat restaurant in Saugus, agreed to pay $110,000 to all tipped employees who worked between 2004 and the present.
