Salt Lake City, UT:(Mar-10-08) Jared Massey, brought charges against the state of Utah, alleging that his civil rights were violated. The suit filed in January alleged that Utah Highway Patrolman Jon Gardner fired his Taser before telling him Massey was under arrest. The confrontation was widely viewed on the Internet. The video has been viewed on YouTube at least 1.7 million times and shows Gardner drawing his stun gun after the 28-year-old Massey, outside his vehicle to proclaim his innocence, refused to accept a speeding ticket.
As part of a settlement reached in the lawsuit, sources on both sides stated that the parties resolved the dispute with the state paying out $40,000. The Highway Patrol stated that the trooper's use of the Taser was justified, but that his attitude was a problem. The attorney general's office stated that the settlement was not an admission of liability, but was an effort to avoid the costs and risks of litigation.
