Ruidoso, NM: (Mar-13-08) The Forest Guardians, Gerald Ford and William Midkiff brought a lawsuit against the city of Ruidoso Downs, over issues related to river water quality and discharge of contaminants from the city's treatment plant. Court records state that the parties reached a consensus and entered into a settlement agreement, resolving the lawsuit.
As part of the settlement reached, the city of Ruidoso Downs agreed to a $40 million rehabilitation of a regional wastewater treatment plant. Ruidoso councilors approved two motions; the first stated that the village will pay 85% of a $152,970 bill for attorneys who represented the plaintiffs in the legal action against the village.
The second motion was related to an initiative by Human Resources Director Barbara Fleming, acting finance director for the village, who proposed to allocate responsibility for a percentage of the costs of some services and expenditures to enterprise funds, where appropriate.
