Mannequin Clones

New York, NY: (Mar-21-08) Rootstein, a company that makes realistic mannequins, said to be sculpted by artists, brought a lawsuit against IL based Forever 21, a clothing company, accusing them of making unauthorized copies of their signature mannequins. The suit alleged that in 2007, Forever 21 purchased some of Rootstein's high-quality mannequins, then made unauthorized copies of them using lower grade material and used them in retail stores in IL.

Sources on both sides said that the companies had resolved the lawsuit and had entered into a settlement agreement, in which Forever 21 was permitted to continue to use the disputed mannequin designs until Jan. 21, 2008, for a fee of $75,000. Following that, Forever 21 was required to destroy all mannequin copies and was not permitted to order any more from Rootstein. In recent developments, Forever 21 has allegedly continued to use the mannequins despite the settlement, prompting Rootstein to sue a second time, alleging breach of contract and copyright infringement.
