Defrauding the Government
Washington, DC: (Mar-26-08) The federal government brought a lawsuit against National Air Cargo, alleging that the Orchard Park, NY, air cargo company defrauded the US Defense Department. The suit, which included criminal and civil charges against the company, was filed following a whistleblower complaints filed by Mark Oehm under the False Claims Act. The Justice Department said that the company pleaded guilty to just one count of knowingly making a material misstatement.
Sources stated that the parties had reached a settlement, in which National Air Cargo will pay the federal government $28 million to resolve allegations. The settlement, reached in New York, resolved claims that the company submitted fraudulent claims for payment for the shipment freight from Jan. 1, 1999, through April 2005. Federal spokespersons said that National Air Cargo engaged in a pattern and practice of knowingly submitting false claims for payment. Under the terms of the settlement agreement, Oehm, a former National Air Cargo employee, will receive $3.3 million as his share of the settlement.
