Misleading Packaging
Fresno, CA: (Mar-31-08) Fresno County brought a lawsuit against 3M Co., alleging that the company sold undersized adhesive tapes. The suit stated that 3M's Scotch and Tartan brand adhesive and packaging tapes were 6% narrower than advertised. It accused the company of knowingly exaggerating the size of the adhesive tapes. The county said that the suit involved violations of the state and federal Fair Packaging and Labeling Act. Records show that the investigation began in 2006, and 3M and the county have been in settlement negotiations since mid-2007.
Sources stated that in a recent development in the case, the two sides reached a settlement agreement, in which 3M Co. has agreed to pay almost $700,000 to resolve the county's allegations. Additionally, 3M agreed to change its labels. Officials said that the company will pay Fresno County $600,000 in civil penalties and an additional payout of $75,000 will go into a state trust fund to benefit county and state weights and measures offices. The company said that it will also pay $18,000 to the state Department of Measurement and Standards, the agency responsible for investigating the case.
