Biotech Patent Infringement
This is a settlement for the Trademark, Copyright, Patent lawsuit.
Cambridge, MA: (Mar-31-08) Codon Devices, Inc. brought a patent infringement lawsuit against Blue Heron Biotechnology, Inc., in the Federal District Court for the District of Delaware regarding five US patents the company allegedly infringed. Sources stated that four of the asserted patents are owned by Duke University and the other by the Massachusetts Institute of Technology. The suit claimed that all five of the patents are exclusively licensed to Codon Devices.
Sources stated that the two sides reached a settlement in the dispute, in which Codon Devices has granted a perpetual, fully-paid sublicense to Blue Heron that will enable the company to continue to use error correction technology as currently employed in its commercial gene synthesis activities. The deal will also provide a release with respect to Blue Heron's past activity. Following the signing of the agreement, Codon Devices will request that the Court dismiss the complaint with prejudice. Sources on both sides refused to disclose the financial terms of the settlement agreement, but stated that that they were pleased with the outcome of the litigation.
