Mining Waste Cleanup
Webb County, TX: (Apr-01-08) Sara Alicia Trautmann and Arturo Tomas Benavides, two landowners, brought a lawsuit against Delaware-based Cogema Mining Inc., a uranium mining company, alleging that the company had breached its contract to restore their property to pre-mining conditions. The two plaintiffs stated that Cogema was to remove waste from the mining, including water they said had been contaminated during the operations, as well as restore the properties' surfaces to their pre-mining conditions. The company refuted the allegations, stating that no water was contaminated by the uranium mining and production.
Sources on both sides stated that the dispute was resolved shortly before it went to trial, and that the parties had entered into a settlement agreement. Under the terms of the deal, Cogema would have to remove contaminated waste from Trautmann's property and restore it to federally and state-mandated conditions. The restoration would allow her to use areas of the property that are currently fenced off, within the next two years. If the company fails to do that within two years, it stands to face a $10,000 per month penalty. Additionally, company spokespersons said that the company will pay $850,000 to Trautmann and $750,000 to Benavides as part of the settlement.
