Musician Fired at 74
This is a settlement for the Discrimination lawsuit.
New York, NY: (Apr-02-08) The US Equal Employment Opportunity Commission brought charges against the New York-based American Ballet Theatre, alleging that it discriminated against one of its trumpeters on the basis of his age. The suit stated that the theatre company wrongly fired the trumpeter because he was deemed to be too old at 74.
The EEOC accused the theatre of violating federal laws, alleging that Henry Nowak, who was fired after playing trumpet in the theater's orchestra for 28 years, was fired as a result of discrimination. The EEOC's suit claimed that Nowak was fired even though his number of performances went up for three years in a row and he had never received complaints.
Sources stated that the two sides had reached a settlement in the dispute, in which the American Ballet Theatre agreed to pay Nowak $18,000 in back pay, resolving the federal age discrimination lawsuit. [STATEN ISLAND LIVE: AMERICAN BALLET THEATRE TRUMPETER, 74, GETS AGE BIAS SETTLEMENT ]
