Generic Drug Patent Infringement
This is a settlement for the Trademark, Copyright, Patent lawsuit.
Baltimore, MD: (Apr-04-08) Nabi Biopharmaceuticals brought a lawsuit against Roxane Laboratories, based in Columbus, OH, and Fresenius Medical Care Holdings Inc, a German company, over PhosLo GelCaps, one of its former drug products. Records show that Fresenius Medical Care Holdings bought the PhosLo product line from Nabi in late 2006. The suit was brought in September 2005, alleging patent infringement, after Roxane filed an application to start marketing a generic version of PhosLo, which are calcium acetate pills that help patients with end-stage renal disease.
Sources close to the case stated that the two parties had reached an agreement for an undisclosed settlement, resolving the dispute. Company sources stated that after Nabi sold PhosLo to Fresenius, it was still subject to counterclaims by Roxane of breaking antitrust laws and, therefore, is still involved in the suit. Following the settlement agreement, the suit over PhosLo GelCaps was dismissed from the US District Court for the Southern District of Ohio.
