Complications at Birth
This is a settlement for the Medical Malpractice lawsuit.
Billings, MT: (Apr-09-08) Blake and Jennifer Jaeger brought a medical malpractice and personal injury lawsuit against St. Vincent Healthcare, after their daughter suffered serious medical problems during birth. The suit was filed in 2006 against the hospital, an anesthesiologist, and Dr. Chimene Dahl. In their lawsuit, the couple stated that their second twin was born with permanent brain damage.
The lawsuit alleged that the brain damage was a result of a communication failure that delayed an emergency Caesarean section when an anesthesiologist was not immediately available. Hospital records show that the Caesarean section was performed as an emergency after Dahl discovered during the birth that an umbilical cord was pinched. Court documents reveal that the anesthesiologist was dismissed from the lawsuit before the trial began.
As part of a settlement reached in the case, the couple agreed to resolve their claims with an undisclosed agreement. The deal was allegedly struck two days into a scheduled three-week jury trial. [MONTANA'S NEWS STATION: FAMILY, BILLINGS HOSPITAL REACH SETTLEMENT IN MALPRACTICE CASE]
